These Terms and Conditions ("Terms") govern your access to and use of PriorityOneSurplus.com (the "Site") and any purchases made through the Site. The Site is operated by Priority One Surplus LLC located at 1744 Tilden Ridge Dr, Hamburg, PA. 19526 ("we," "us," or "our").

By accessing, browsing, or purchasing from the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

1. Use of the Site

You must be at least 18 years of age to use the Site. Certain products (e.g., ammunition, restricted accessories) may require you to be 21 years of age or older and to comply with all applicable federal, state, and local laws. You agree to use the Site only for lawful purposes and in accordance with these Terms.

2. Products and Eligibility

We sell military surplus items, including but not limited to clothing, gear, equipment, tactical accessories, and related products ("Products"). All Products are sold "as is" and "where is", with any described condition (e.g., new/unissued, used, serviceable).

Some Products may be subject to federal export controls under the International Traffic in Arms Regulations (ITAR) and/or Export Administration Regulations (EAR). We do not export Products outside the United States. You represent and warrant that you are a U.S. person (as defined under applicable law) and will not export, re-export, transfer, or divert any Product in violation of U.S. export laws.

It is your sole responsibility to determine whether a Product is legal to possess, purchase, or use in your jurisdiction. We make no representations regarding legality in any specific location.

For any Product subject to age restrictions (e.g., ammunition), you certify that you meet all age, background check, and legal requirements under federal, Pennsylvania, and local law.

3. Orders and Payment

All orders are subject to acceptance by us. We reserve the right to refuse or cancel any order for any reason, including errors in pricing, product availability, or suspected fraud. Prices are in U.S. dollars and do not include shipping, taxes, or duties unless stated. You are responsible for all applicable taxes.

Payment is processed through our secure third-party processor. By placing an order, you authorize us to charge the provided payment method.

4. Shipping and Delivery

We ship only to addresses within the continental United States (unless otherwise specified). Certain Products may have shipping restrictions. Delivery times are estimates only. Risk of loss passes to you upon handover to the carrier. Please see our shipping and return policy page.

You agree to comply with all shipping laws and carrier policies. We are not responsible for delays, customs issues (if international forwarding occurs), or prohibited shipments.

5. Returns, Refunds, and Exchanges

Due to the nature of surplus products, all sales are final except as required by law. Returns may be accepted within 15 Days only for unused items in original condition, subject to our Return Policy. 6. Product Descriptions and Condition

We strive for the most accurate descriptions, photos, and condition ratings, but there may be minor variances in condition or construction. All Products are sold without warranties unless explicitly stated.

7. Intellectual Property

The Site, logos, text, images, and content are our property or licensed to us. You are granted a limited, non-exclusive license to view and purchase for personal, non-commercial use only. No reproduction, distribution, or commercial use without written permission.

8. Disclaimers and Limitation of Liability

THE SITE AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE PRODUCT IN QUESTION.

9. Indemnification

You agree to indemnify, defend, and hold us harmless from any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms, misuse of Products, or breach of any law or third-party rights.

10. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict of laws principles. Any disputes shall be resolved exclusively in the state or federal courts. You waive any objection to venue or inconvenience of forum.

11. Termination

We may terminate or suspend your access to the Site or cancel orders at any time, without notice, for any reason, including violation of these Terms.

12. Changes to Terms

We may update these Terms at any time. The updated version will be posted here with a revised "Last Updated" date. Continued use of the Site after changes constitutes acceptance.

13. Miscellaneous

If any provision is held invalid, the remainder remains in effect. No waiver of any term is a further waiver. These Terms constitute the entire agreement.
